BILL OF RIGHTS OF AIRLINE PASSENGERS

Nagpalabas ang DOTC at DTI ng pinagsamang Administrative Order No.1 na tinatawag na “Bill of Rights for Air Passengers and Carrier Obligations”. Tungkol ito sa mga karapatan ng mga pasaherong inaapi ng Cebu Pacific, Philippine Airlines at iba’t –ibang airlines na nagbibigay ng murang ticket, pero basura naman ang turing sa mga pasahero.

Para sa mga laging nag-eeroplano, makinig mabuti sa tatlong mahahalagang karapatan ninyo:

I.       Right to be Provided with Accurate Information Before Purchase

 

1. Right to full, fair, and clear disclosure of the services offered and all other terms and conditions of the contract of carriage.

Nakalagay dapat sa ticket ang lahat-lahat (English at Filipino) tulad ng ipipresentang dokumento sa check-in, refund, rebooking, limitasyon sa check-in, etc. Dapat din daw ipaliwanang verbally sa pasahero sa lenguaheng madaling intindihin.

 

2. Right to clear and non-misleading advertisement of and important reminders regarding fares.

Nakalagay dapat sa mga advertisement ang conditions, restrictions, refund, & rebooking policies, baggage allowance, government taxes & fuel surcharges, other mandatory fees, contact details ng carrier, number of seats offered , duration ng promo. At dapat 1/3 ang laki ng mga reminders and disclosures sa advertisement at hindi fine print na kailangan mo pa ng microscope para basahin.

 

II.    Right to Receive Full Value of Service

 

1. Right to be processed for check-in.

Hindi dapat sabihing late ang pasahero kung nasa check-in area na siya isang oras bago ang Estimated Time of Departure [ETD]. Kapag nasa kordon ka na at nakapila sa check-in counter isang oras bago ang ETD, hindi ka late at dapat pasakayin ka. Hindi mo na kasalanan kung mabagal mag-proseso yung babae sa check-in counter. Huwag pumayag na ma-resked o hindi pasakayin. Hindi ka-late! It’s not you, it’s them.

 

2. Right to Sufficient Processing Time

a. Dapat magbukas ang check-in counter sa international airports (at ibang airports designated ng DOTC), dalawang (2) oras bago ang ETD. Para sa ibang airports dapat magbukas sila isang (1) oras bago ang ETD.

b. Magbigay ng hiwalay na check-in counter sa mga pasaherong aalis ng isang (1) oras bago ang ETD.

c. Magbigay ng hiwalay na check-in counter sa mga PWD, senior citizens at taong “requiring special assistance or handling”.

 

3. Right to Board for Purpose of Flight

Dapat pasakayin ang pasahero sa eroplano, o hingin ang kanyang pahintulot kung hindi papasakayin, except:

a. Overbooking. Pwede pa ring mag-overbook ang mga airlines. Pero dapat maghanap ng volunteers ang airline na payag ibigay ang kanyang upuan. Kung walang sapat na volunteers, dapat lakihan ng airline ang compensation para pumayag ang mga pasahero. Tawag dito “Auction System” (Tip: Kapag may overbooking, magpakipot muna upang lakihan ang offer tulad ng libreng hotel at trip to Europe)

b. Legal or other valid causes. Syempre kung terorista ka o kumakanta ka ng “Sex Bomb, Sex Bomb, You’re a Sex Bomb…”, pwede kang hindi pasakayin sa eroplano.

 

III.   Right to Compensation

Cancellations

1. Cancellation 24 hours before the ETD, kasalanan ng carrier.

a. Right to be notified beforehand

b. Right to rebook or reimburse, at the option of the passenger

 

2. Cancellation less than 24 hours before the ETD, kasalanan ng carrier.

a. Right to be notified beforehand.

b. Right to amenities (food, drinks, hotel accommodations, masahe, etc.)

c. Right to be reimbursed of the fare, taxes, surcharges, and other optional fees. Lahat ng binayaran mo sa loob ng airport (pwera agahan at diatabs).

d. Right to be endorsed to another air carrier without paying any fare difference. Kung business class lang available sa paglilipatan, swerte mo. Huwag pumayag kung ililipat ka sa Superferry.

e. Right to rebook the ticket without any additional charge.

 

3. Cancellation due to other causes (force majure, safety and/or security reasons.)

a. Right to be reimbursed of the full value of the fare. Walang amenities wawa.

 

Flight delay

1. Flight delay three (3) hours after the ETD whether attributable to carrier or not.

a. Right to avail refreshments or meals (Yes!)

b. Right to free phone calls, text, emails and first aid if necessary (Tipid sa load)

c. Right to rebook or refund ticket

d. Right to be endorsed to another carrier

 

2. Flight delay six (6) hours after ETD attributable to carrier.

a. Right to consider the flight cancelled to avail rights and amenities provided for in case of actual cancellation. [See III., No.2]

 

3. Tarmac delay at least 2 (two) hours after ETD

a. Right to sufficient food and beverage. Pagdasal ma-delay sa tarmac ang eroplano 2 oras pagkatapos ng ETD para libre pagkain.

 

Delayed, Lost or Damaged Baggage

1. Right to be informed of the fact of offloading.  “Hi Sir, sorry po hindi po sinama yung bagahe ninyo sa eroplano dahil amoy bagoong”

2. Right to P2,000 compensation for every 24 hours of delay. Kung payong lang hindi nasama, naku swerte mo, dalawang libo agad yun.

3. Refund of baggage fees if not delivered within 24 hours from arrival of flight.

4. Kung nawala o nasira ang bagahe, ang international  convention ang mag-aaply sa international flights. Isa sa mga international conventions na signatory ang Pilipinas ay ang “Warsaw Convention” na nagbibigay ng 20USD per kilogram (ayon sa Wikipedia). Kung domestic flight naman, kalahati nito, in the maximum equivalent ng bagahe.

Ang international conventions din ang mag-aaply in case of death or bodily injury of the passenger, weather international or domentic flight.

5. Right to immediate payment of the affected passenger sa counter sa airport, o sa main office or branch ng carrier, at the discretion of the passenger by check, cash o anumang dokumento necessary to claim the compensation, convertible to cash within 15 days .
